These Terms & Conditions ("Terms") are a binding agreement between you and Optimal Fades, LLC, a limited liability company organized in the State of Arizona, United States ("we," "us," or "our"). By using our website, booking an appointment, purchasing products or memberships, or opting in to our text messaging program, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old to agree to these Terms and to opt in to our SMS program. Persons under 18 may receive our services in-shop with the consent of a parent or legal guardian. By agreeing, you represent that you meet these requirements.

2. Services

We provide barbershop services including haircuts, beard services, shaves, and related grooming services at our location in Parker, Arizona. We also sell grooming products, branded merchandise, and chair memberships. Service descriptions and pricing are on our website and subject to change without notice.

3. Appointments

Booking

Appointments may be booked online through our booking platform, by phone, by text, or in-shop. All bookings are subject to availability. Members receive priority booking windows.

Cancellations & No-Shows

• Cancel or reschedule up to 4 hours before your appointment at no charge.
• Same-day cancellations and no-shows are charged 50% of the scheduled service.
• Members receive one (1) free late-cancel pass per calendar quarter.
• Repeated no-shows may result in suspension of booking privileges.

Late arrivals

If you arrive more than 10 minutes late, we may modify the service, shorten your appointment, or reschedule at our discretion. The full price may still apply.

4. Payments & Pricing

• All prices are in U.S. dollars and are subject to change without notice.
• We accept cash, major credit cards, Apple Pay, Venmo, and Cash App.
• Gratuities are appreciated but not required.
• All sales of products and gift cards are final unless defective.

5. Memberships

• Memberships are billed monthly and auto-renew until canceled.
• You may cancel anytime; cancellation takes effect at the end of the current billing cycle.
• Included cuts roll over for up to 60 days. Unused cuts beyond 60 days are forfeited.
• Membership benefits are non-transferable unless expressly stated.
• We reserve the right to suspend or terminate memberships for abuse, non-payment, or violation of these Terms.

How to opt in

You may opt in by submitting a form on our website, booking through Booksy, verbally providing your number in-shop, or texting us first. Opting in represents your express consent to receive SMS/MMS messages from us at the phone number provided.

Message types

Messages may include appointment reminders, booking confirmations, promotional offers, and shop updates. Appointment-related messages (reminders, confirmations) are transactional and may be sent regardless of marketing opt-in.

Frequency

Message frequency varies based on your activity. Typical frequency is up to 8 messages per month.

Fees

We do not charge for the messages themselves. Message and data rates may apply based on your mobile carrier's plan. Contact your carrier for details.

Opt-out and help

• Reply STOP to any message to unsubscribe from promotional messages.
• Reply HELP for assistance, or contact us at 623.323.3400 or hello@optimalfades.com.
• Reply START or UNSTOP to re-subscribe.

Carriers and availability

Available on major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Program availability and features may change without notice.

7. Acceptable Use

When using our website, services, or SMS program, you agree not to:

• Harass, threaten, or abuse staff, barbers, or other clients
• Provide false or misleading information
• Reverse-engineer, scrape, or interfere with our website
• Use our services for unlawful purposes
• Impersonate another person or entity

We may refuse service, suspend accounts, or remove content for any violation.

8. Intellectual Property

Our name, logo, branding, website content, product designs, and marketing materials are our property or licensed to us, protected by trademark and copyright law. You may not copy, reproduce, or use our intellectual property without our prior written permission.

9. Disclaimers

Our services are provided "as is." We make no warranties, express or implied, regarding fitness for a particular purpose or non-infringement. We do not warrant that our website will be error-free or uninterrupted. Haircuts and beard services involve inherent subjectivity; results may vary.

10. Limitation of Liability

To the maximum extent permitted by law, Optimal Fades, LLC, its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of our services. Our total liability for any claim is limited to the amount you paid to us in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify and hold harmless Optimal Fades, LLC from any claims, damages, or expenses arising out of your use of our services or violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Arizona, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of our services after changes take effect constitutes acceptance.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
